Tennessee Supreme Court lets lower court ruling stand: CCA is defacto public agency, must produce records

The Tennessee Supreme Court has decided not to hear arguments on a public records dispute between Nashville-based Corrections Corporation of America and Alex Friedmann, an outspoken critic of the private prison operator.

The court’s decision, announced Monday, leaves in place last year’s ruling by the state Court of Appeals that Corrections Corp. "is the functional equivalent of a governmental agency and, therefore, subject to the Public Records Act."

Corrections Corp. had tried to deny Friedmann’s request for various company records, arguing that the state’s open records law does not apply to it. Friedmann is a convicted felon and former prisoner in a Corrections Corp. prison, associate editor of Prison Legal News and vice president of the Private Corrections Institute.
