LETTER OF CENSURE
Dear Trooper Castro:
On August 8, 2015 you were operating your assigned Division vehicle when you were
involved in a troop car accident. This accident has been reviewed at Troop Headquarters and it was
determined to have been preventable on your part. On December 7, 2015 you appeared before me,
executed a waiver, and requested that I adjudicate the disciplinary action.
The accident occurred as you were traveling southbound on State Route 300 in the Town
of Newburgh in pursuit of an uninvolved vehicle. As you approached the intersection of Route 300 and
ST-17K, with emergency lights and sirens activated, you slowed and proceeded through the red traffic
signal. You were struck by another vehicle that was traveling west on ST-17K with a green traffic signal.
Although the driver of the other vehicle failed to yield to an emergency vehicle, your speed and passing
through a red signal light were the primary cause of this accident. As a professional driver, you are
expected to drive more carefully.
It is my decision that you receive a letter of censure and the loss of one (1) vacation day
for your actions. I trust that you will drive more cautiously in the future.

Any right to appeal the Troop Commander's adjudication, which may be a
determination of unfounded or, upon a finding of guilt, the imposition of
the following penalties:

dated August 15, 2015, regarding the above-subject matter.
I have reviewed the attached report submitted by Sergeant FORTUNA and concur with
his findings. On August 8, 2015, Trooper VINCENT T. CASTRO was working a 2 shift out of.SP
Montgomery and operating Division vehicle 2F39. At approximately 12: 11AM, Trooper CASTRO was
travelling southbound on State Route 300 in the Town of Newburgh in a pursuit of an uninvolved
vehicle. Trooper CASTRO approached the intersection with ST- l 7K with emergency lights and sirens
activated. He slowed 2F39 and proceeded through the right traffic signal and w
vehicle -2 that was travelin west on ST-17K ,Yith a een traffic si nal.
Investigation determined that Trooper CASTRO was injured as a result of this motor
vehicle accident which demolished 2F39. Although the operator ofV-2 failed to yield the right ofway
to Trooper CASTRO, Trooper CASTRO'S speed was a factor in this accident. Trooper CASTRO
incurred the loss of eight (8) days of duty time. I recommend that this matter be classified as
"Preventable" on the part of Trooper CASTRO.

On August 8, 2015, Trooper VINCENT T. CASTRO (BOD 05/08/06) was
working a scheduled 2 shift out of SP Montgomery, utilizing marked Division vehicle 2F39
(Vl ). Trooper CASTRO engaged in a pursuit of an unknown vehicle south on State Route 300
in the Town of Newburgh for traffic violations. The suspect vehicle was operated at an
extremely high rate of speed and in an aggressive manner as it traveled toward State Route 17K.
With emergency lights and siren activated, Trooper CASTRO approached and entered the
inwrsection of Routes 300 and 17K against a steady red traffic signal, failing to yield the right of
way to traffic traveling on Route 17K. V2, a 2008 Honda CRV, operated by JOSE SEGURA
was traveling west on Route 17K, entered the intersection with the steady green traffic signal.
V2 subsequently collided with 2F39. Following the collision with V2, 2F39 drove off the west
shoulder of Route 300, struck a utility pole and overturned onto its passenger side. Trooper
CASTRO and the driver and assen ers ofV2 were all tran orted to St. Luke's Hos ital for
Investigation into this incident revealed that Trooper CASTRO sustained injuries
resulting from a motor vehicle accident that occurred while he was on duty and in the
perfonnance of his duties. With regard to the motor vehicle accident, investigation found that
although in emergency operation, Trooper CASTRO did not take the appropriate precautionary
measures and slow as necessary for safe operation when he entered the intersection against the
traffic signal, thereby causing the collision. Based upon this conclusion, it is reconunended that
this accident be classified as "Preventable". Case closed by investigation.
PURSUIT/DMSION VEHICLE PIAA-2F39/0N DUTY INJURY TO
On August 8, 2015 I was instructed by SERGEANT THOMAS A. FORTUNA to
compose a memorandum in reference to PURSUIT/DIVISION VEHICLE PIAA-2F39/ON
DUTY INJURY TO MEMBER. I was advised of my rights to representation pursuant to Article
16.2 of the contract by Sergeant THOMAS A. FORTUNA on August 8, 2015, and I submit the
following account.
On August 7, 2015 I was working a scheduled 2 shift out of SP Montgomery in marked
unit 2F39. At approximately U :50PM while westbound on I 84, I was dispatched by SP
Middletown to the area ofl 84 Exit 5 for a report of vehicles closing the lanes of traffic for the
purpose of a possible car race. I took up a stationary position in between exit 5A and exit 6
facing eastbound traffic. On August 8, 2015 at approximately 12:02 AM I observed two vehicles
approaching my location at a high rate of speed estimated to be I 05MPH with multiple cars
following behind. The two vehicles passed my location at which point I entered onto I 84 ·
eastbound. I maintained a visual ofboth vehicles and observed both vehicles exit at 7A (NYS
THRUWAY), at which point I observed a red vehicle enter onto the NYS Thruway, and a dark·
colored.vehicle enter into the SP Newburgh Thruway Barracks parking lot which leads towards
State Route 300. I attempted to stop the dark vehicle by activating my emergency lights and
sirens, while navigating through the SP Newburgh Thruway Barracks parking lot. At this point
the operator of the unknown dark vehicle crossed over the Thruway off- ramp and onto the
onramp for State Route 300. At approximately 12:10 am, I advised SP Middletown ofa failure
to comply. The dark colored vehicle made a right turn on to State Route 300 southbound and
began to .accelerate. I estimated the speed of the vehicle to be approximately 118 MPH. While
pursuing the vehicle on State Route 300, I was traveling at a speed of approximately 100 and 110
MPH in an attempt to maintain visual of the vehicle and subsequently stop same. Upon approach
to the intersection of State Route 17K, I slowed my vehicle and checked for any oncoming traffic
with my emergency lights and sirens activated. As I slowed at the intersection I did not observe

any vehicle. While on a steady red light I continued into the intersection with my emergency
lights and .sirens activated, at which point I observed a vehicle traveling westbound on State
Route 17K. I was unable to avoid the vehicle at which point V-2 struck my vehicle on the driver
side door. After 2F39 was struck it continued across the roadway and became airborne striking a
utility pole and coming to rest on the passenger side at the base of the pole on State Route 17K.
A few pedestrians assisted in flipping 2F39 back upright at which point I exited the vehicle
through the passenger side door and laid down awaiting the arrival of emergency personnel. ~

1. On August 8, 2015 at approximately 12:11 a.m., I was contacted by SP Middletown and advised that 2F39 was
involved in a pursuit that resulted in a PIAA. The collision was reported to have ocurred at the intersection of State
Routes 300 and 17K in the Town of Newburgh. I notified Zone 2 Commander Captain BRENDAN R. CASEY of the
accident and I was assigned to investigate.
2. On August 8, 2015 S~rgeant DANIEL QUINONES and I responded to the location of the PIM. State Route 300
and State Route 17K is an intersection consisting of two, four lane state highways with multiple turning lanes from
each direction controlled with a center traffic light. State Route 17K travels east and west and State Route 300
travels north and south. The weather was clear and the driving surface was dry. Upon our arrival at the scene, both
Division vehicle 2F39, 2014 Dodge Charger (V1} and a 2008 Honda CRV bearing New Yprk registra tion CYU5592
(V2) were still located in their final point of rest following the collision. V-1 was located on the southwest corner of
State Route 17K against the telephone pole and had sustained heavy front end damage on the driver's side and was
demolished. V-2 was located just west of the intersection of State Route 17K and State Route 300 and came to rest
in the eastbound lane of State Route 17K. V-2 had sustained heavy front end damage on the passenger side and
was demolished.
3. On August 8, 2015 I advised Captain CASEY that the involved member was Trooper VINCENT T. CASTRO {EOD
05/08/06) from SP Montgomery. Trooper CASTRO had been pursuing an uninvolved vehicle on Route 300 when he
collided with a 2008 Honda CRV (V-2) at the intersection with Roule 17K I advised Captain CASEY that Trooper.
CASTRO had sustained neck, back and knee pain and was being transported to St. Luke's Hospital. The driver and
passengers of V-2 had also suffered minor injuries and were being transported to St. Luke's Hospital. All parties
involved were transported via ambulance to Sl Luke's hospital. I requested, and Captain CASEY approved Troop
F-CRU response to the scene. Captain CASEY responded to the accident scene.

4. On August 8, 2015, witness (WT-1), JOYCE LAPORTA
as
interviewed. She stated in sum and substance that she was driving westbound on St-17K approaching the
intersection of St-1 ?K and St-300. Upon approach, the light facing her was turning red and as she approached the
light, she observed police lights and noticed the police officer was chasing a speeding vehicle traveling south on St300. Both vehicles drove through the intersection when she observed a silver SUV also enter the intersection on St17K. At that point, the police vehicle struck the SUV and the· police vehicle started to rollover and finally came to rest

y were traveling west on St 17K. She observed a police vehicle chasing a speeding vehicle that went through
the intersection of St 17K and St 300. The police vehicle was traveling south on St 300 when a silver SUV traveling
east on St 17K entered the intersection. The police vehicle struck the SUV and the police vehicle started to roll over.
RAVELO never got a good look at the vehicle the police car was chasing. A supporting deposition was obtained from
RAVELO and is attached to this report as enclosure #2.
6. On August 8, 2015, witness (Wf-3), SAMUEL IVY
as interviewed.
He stated in sum and substance that about midnight he was stopped northbound at the traffic light at St 300 and St
17K He saw the lights of a police car and heard the engine of a car that he was chasing. When the car the police
was chasing approached the intersection, it ~s apparent he was.not going to stop. The car appeared to be a black
Honda Civic hatch back. The car appeared to be going over 90mph. The black Honda had a red light that he ran
through and other vehicles started to pull over because they saw the cop had his emergency lights on. There was a
gray SUV that appeared to be making a left turn from 17K westbound onto St 300 northbound. It appeared the SUV
did not see the cop car and the cop car struck the SUV as he passed through the intersection. IVY stated that he
heard the police sirens and saw the lights as he approached the intersection. The police car lost control after he
struck the SUV and then struck a telephone pole. The police car was tipped on its side after the accident and he
assisted with tipping it back upright. A supporting deposition was obtained from IVY and is attached to this report as
enclosure #3.

turn onto St 17K. He saw a Honda traveling south on St 300 go past him at a high rate of speed. He saw the light
was red on St 300 for about 3 or 4 seconds. As soon as the Honda passes through the intersection, he observed a
gray SUV which appeared to be making a right turn from St 17K to St 300 south. He saw a police car chasing after
the Honda with his lights and sirens on. He saw the police car collide with the gray SUV and then the police car went
up an embankment and looked as if it tipped over after it struck a telephone pole. The Honda the police car was
chasing looked like a hatchback with a loud exhaust and tinted windows. A supporting deposition was obtained from
DUKAS and is attached to this report as enclosure #4.
8. On A1Jgust 8, 2015, witness (WT-5), JOHN VICARI
was
interviewed. He stated in sum and substance that abou

He also observed a blue SUV enter the intersection of St 17K and St 300 at which point the vehicles struck each
others front ends. He saw the Troopers car flip on its side and landed on the passenger side. He ran over and
helped tipped the car back onto its wheels. He stated he attempted to get the Trooper out of the car, but he couldn't
so. he broke the rear driver's side window to help the Trooper out of the car. A supporting deposition was obtained
from VICARI which is attached to this report as enclosure #5.

9. On August 8, 2015, witness (Wf-6), ROBERT MARQUEZ
was interviewed. He stated in sum and substance at about 12:15 a.m., he was in the Sunoco parking lot on St 17!<.
He observed a small vehicle traveling south on St 300 driving at a high rate of speed. He thought the vehicle was
going in excess on 1DO to 120 mph and he believed that it went through the red light. He observed the lights and
sirens of a State Police car chasing the small car. He observed the Trooper go through the light and struck a blue
SUV that was entering the intersection on St 17K heading towards Montgomery. The Troopers car landed on its side
and he helped to flip it over. The small dark vehicle that the Trooper was chasing south on St 300 never stopped and
kept going. A supporting deposition was obtained from MARQUEZ and is attached to this report as enclosure #6.

10. On August 8, 2015 Investigator DANIEL SMITH, Trooper ERIC ANDERSON and Trooper KYLE MARKLE from
the Troop F CRU arrived on the scene. Investigator SMITH photographed the scene and completed a Genl 340
which is attached to this report as enclosure #7.
11. On August 8, 2015 Sergeant QUINONES responded to the Sunoco gas station on St 17K to ascertain if they had
any video surveillance in the area where the accident occurred. He was advised that they do not.
12. On August 8, 2015 Sergeant QUINONES and I responded to St Luke's Hospital and we interviewed Trooper
CASTRO. He stated that he was working a scheduled 2 shift out of SP Montgomery in marked unit 2F39 (V-1). At
approximately 11 :50 p.m., he was dispatched by SP Middletown in the area of 184 near exit 5 for a report of several
vehicles closing the lanes of traffic so they could drag race. Trooper CASTRO took a stationary position between exit
SA and 6. Several minutes later, he observed two vehicles traveling at a high rate of speed traveling eastbound. He
maintained a visual on both vehicles and estimated their speed in excess of 105 MPH. Both vehicles approached
exit 7A and one vehicle described as a red vehicle entered the NYS Thruway and the other vehicle described as a
dark colored vehicle entered into the SP Newburgh Thruway barracks. The vehicle was heading towards St Rte 300:
Trooper CASTRO pursued the vehicle heading towards St Rte 300 and activated his emergency lights and sirens in
an attempt to stop the vehicle. He then notified SP Middletown of the failure to comply. The vehicle made a right
onto St Rte 300 southbound and accelerated. Trooper CASTRO estimated the vehicles speed in excess of 11 SMPH
and he was traveling in excess of 11 O MPH in an attempt to maintain a visual on the car and also to attempt to stop
the vehicle. Upon entering the intersection of St Rte 300 and St Rte 17K, Trooper CASTRO slowed 2F39 to check
for any oncoming traffic with his emergency lights and sirens still activated. He did not observe any vehicles in the
intersection and proceeded through. At that point, he did not obsE!rve V-2 traveling westbound on St Rte 17K V-2
subsequently struck the drivers side door of 2F39 which caused 2F39 to go across the roadway, become airborne
and strike a telephone pole. 2F39 landed on the passenger side and with the assistance of several witnesses was
pushed back over by several bystanders. Trooper CASTRO exited the vehicle from the rear passenger side door
and lay down until emergency personnel arrived. A memorandum was obtained from Trooper CASTRO and is
attached to this report as enclosure #8.

13. On August 8, 2015, V-2 operator (S-1, T-2), JOSE SEGURA
was
interviewed. He stated that at about midnight he was operating his 2008 Honda CRV bearing NY registration
CYU5592 (V-2). He stated that he just ca
to St 17K westbound. He was heading
towards his house in Walden NY. His son
was in the front passenger seat and his
mother in law SOCORRO PLACIDO was in e rear passenger sea . e stated that they all had their seatbelts on.
He approached the intersection of St 17K and St 300 and he had a green light. He was traveling straight down St
17K towards Walden so he could go home. As he started through the intersection, he saw a black car (unknown
make or model) traveling south on St 300 going towards New Windsor at a extremely high rate of speed crossing his
path. He then proceeded through the intersection and he checked to the left and the car that went through the
intersection was gone. He stated that he was almost through the south bound side of St 300 when he got hit by the
Trooper on the front passenger side who was also traveling south on 300. The airbags deployed in my car and he
did not black out. He did not remember how fast he was going through the intersection but he stated that it was not
that fast. After the accident, his son and mother in law struggled to ·get out of the car. They were riot injured at the
time of the accident and waited for emergency personnel to arrive. A supporting deposition was obtained from
SEGURA and is attached to this report as enclosure #9.

Walden. Atthe intersection of St 17K and St 300, they saw a car·go through the intersection passing a red light. His
father asked .him if he saw the car and he stated he did not. As soon as he said rio to his dad, they were hit in the
front of the car. They got out of the vehicle and he saw a police car rolled on its side. He stated that several people
came over to see if we were all right. He further stated that he was in the front passenger seat and he had his
seatbelt on and that he had a scrape on his right elbow and that his chest hurt A supporting deposition was obtained
from SEGURA and is attached to this report as enclosure #10.

She stated that she was asleep at the time of the accident and was awoken y

19. On August 8, 2015, 2F39 (V1) and NY Reg CYU5592 (V2) were towed to, and secured in the SP Middletown
impound lot as per CRU-lnvestigator SMITH.
20. On August 9 ! 2015 Investigator BRIAN SANTOS {SP Montgomery) responded to Newburgh Nissan to ascertain
if they had any video surveillance of the area where the accident occurred. They advised that they did not.
21. On August 10, 2015 the NYS Accident Reporting System was contacted and case #00508001 was assigned.
Trooper CASTRO'S loss of duty time is unknown.
22. On August 10, 2015 I spoke with CRU-lnvestigator SMITH who advised that the black box data from 2F39 was
obtained. The date indicated that 5 seconds prior to impact 2F39 was traveling at 106 mph. At the time of impact
2F39 was traveling at 77 mph.
23. On August 12, 2015 I completed an MV 104N MV104L, Tracs #SPM2104N8KT1, which is attached to this report

On August 8, 2015 at around midnight, I was in my car stopped at a traffic light traveling on route 300 northbound. I was at the
intersection with route 17K. I saw the lights of a police car and I heard the engine of a car that he V'JaS apparently chasing.
When the car the police was chasing approached the intersection it was clear to me that he was not stopping. The car looked
like a dark color Honda civic hatch back. I would not be surprised if the Honda was traveling 90 mph or more. His light was
red and he ran through the intersection. Cars started pulling over because they saw the cop car's fights on. There was a gray
SUV that was making a left turn from route 17K wlb onto route 300 northbound. It did not look like he saw the cop car and the
cop car struck him as he passed through the intersection apparently pursuing the Honda. I heard the police sirens as the
police car approached the intersection. I saw the police car lose control after the initial collision and then strike a telephone
pole. The police car was tipped on its right side and I assisted in tipping it back upright.

Synopsis of Pursuit:
On August 8, 2015 at approximately 12:10 AM I attempted to stop a dark colored vehicle which was involved in a illegal street race on 184. I

observed the vehicle exit 184 eastbound at Exit 7A and subsequently cross over traffic and into the State POiice Thruway Barracks. I advised SP
Middletown of the failure to comi?IY and observed the vehicle make a right tum onto State Route 300. While on State Route 300 I estimated the
vehicle to be traveling ata speed of approximately 118 MPH. Upon approach of the intersection of State R.oute 300 and State Route 17K I slowed to

observe any traffic traveling through the intersection. I did not observe any vehicles attempting to enter the intersection at which point I entered into
the intersection with my emergency lights and sirens activated. Upon entering in the intersection I observed a vehicle operilting westbound on State
I
Route 17K. I was unable to avoid the vehicle ~t which point V-2 struck my patrol vehicle in the driver's side door. I continued through the intersection
at which point I became ~irbome striking a utility pole and coming to rest at the base of the pole.

pursuing. As he approached the intersection of St Rte 300 and ST Rte 17K, he had his emergency lights and sirens activated. Trooper

On 08/08/15, Trooper VINCENT CASTRO. working a scheduled 2 shift out of SP Montgomery, took a stationary position on
Interstate 84 after being advised by SP Mdd1e~<Jwn of two vehicles racing on the interstate, heading eastbound. Trooper
CASTRO observes both vehicles travsling at a high rate of speed and proceeds after them in marked Division vehicle 2F39
with emergency lights and siren a~tivated. Trooper CASTRO observes one of the vehicles enter the Thruway (l-87) and the
second vehicle exit onto State _foute 300 at a high rate of speed and advises SP Middletown of the pursuit. Suspects vehicle
continues l_W,;~ ,i~p••la.~.U!~Sn-State Route 300, passing a red llght at the intersection with State Route 17K. Trooper CASTRO
enters tra intersection and collides with V-2, a 2008 Honda CRV. 2F39 continues south and struck a utility pole. V-2 came
.... toJrest on the westbound lanes of State Route 17K. Trooper CASTRO along with occupants (3) of V-2 transported to St.
Luke's Hospital via ambulance. The pursuit lasted less than a minute covering less than a mile and was not monitored due to
the short duration. Troop F CRU and Zone Two Commander Captain Brendan Casey at scene . ARS to be notified during
business hours .
