$25,000 Settles Rensselaer, New York Police Assault Case

Kristopher Remington, 28, received a settlement by the city of Rensselaer, New York of $25,000 after suing it for police brutality.

On January 31, 2004, Remington was involved in an altercation outside of a bar, and the police were called. According to Remington, one of the officers who responded slammed his head, face and body into a police car and kicked or punched his face three or four times, without provocation or cause.

After being released from jail, Remington sought medical treatment. He was diagnosed, by an ear doctor, with a perforated ear drum and subsequently underwent surgery. He sued the city, alleging that the officers' actions constituted assault which led to his ear injury and subsequent hearing loss.

The defense counsel for the city argued that Remington's hearing problem existed before the incident. Both parties agreed to a pretrial settlement of $25,000.
